Another Judge Rules Against Trump’s Invocation of Alien Enemies Act

The judge says the president did not cite any actual aggression and violated the Fifth Amendment.

A federal judge in Texas determined on June 9 that President Donald Trump misapplied alien enemy laws when he tried to remove them from the United States, paying tribute to members of the Venezuela Tren de Aragua gang.

In a 56-page opinion, US District Judge David Brions said Trump violated the assurance of a legitimate constitutional process and failed to demonstrate that Tren de Aragua (TDA) was engaged in the type of aggression that the president allowed to invoke the law. His comments, which repeated the comments of three other federal judges, were in conflict with at least one person in Pennsylvania.
